These Terms of Service (“Terms”) govern your access to and use of the WordPressDeploy.com website, software, applications, and related services (collectively, the “Service”). By using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
1. Eligibility and authority
You must be legally capable of entering into this agreement. If you use the Service for an organization, you represent that you have authority to bind that organization, and “you” includes the organization.
2. The Service
WordPressDeploy provides tools and workflows intended to help users configure, deploy, operate, monitor, back up, and manage WordPress websites. Features may be offered in early access, beta, free, or paid form. We may improve, add, restrict, or discontinue features. When practical, we will provide reasonable notice of material changes.
Early-access and beta features may be incomplete, change without notice, and experience more errors or downtime than generally available features. They should not be used as the sole repository or backup for important data.
3. Accounts and security
When an account is required, you agree to provide accurate information, keep it current, protect credentials and recovery methods, and promptly notify us of suspected unauthorized use. You are responsible for activity under your account and for choosing appropriate access permissions for team members and connected services.
4. Your sites, data, and responsibilities
You retain ownership of websites, code, content, configuration, and other materials you submit (“Customer Content”). You grant us a limited, non-exclusive, worldwide license to host, copy, transmit, modify, and otherwise process Customer Content only as necessary to operate, secure, support, and improve the Service or comply with law. This license ends when the content is deleted from active systems, subject to ordinary backup retention and legal obligations.
You are responsible for Customer Content; the legality and security of your websites; licenses for WordPress themes, plugins, fonts, media, and other materials; domain and hosting accounts; reviewing configuration and deployment results; and maintaining independent, tested backups.
5. Acceptable use
You may not use the Service to:
- Violate law or another party’s intellectual-property, privacy, publicity, or contractual rights.
- Upload malware, exploit systems, evade security controls, or obtain unauthorized access.
- Distribute spam, phishing, deceptive content, or abusive material.
- Interfere with the Service, impose unreasonable load, probe vulnerabilities without permission, or circumvent usage limits.
- Scrape or extract data except through functionality we intentionally provide.
- Deploy content or services that are illegal, harmful, fraudulent, or designed to facilitate wrongdoing.
- Resell or commercially exploit the Service except under an agreement that permits it.
We may investigate suspected violations and suspend access reasonably necessary to protect users, third parties, or the Service.
6. Connected services
You may authorize WordPressDeploy to interact with third-party platforms. You represent that you have authority to provide that access. Your use of connected services remains subject to their terms, fees, limits, availability, and security practices. You may revoke an integration through the relevant provider or available Service controls.
7. Intellectual property
The Service, excluding Customer Content, is owned by WordPressDeploy and its licensors and protected by applicable intellectual-property laws. These Terms provide a limited, revocable, non-transferable right to use the Service; they do not transfer ownership. You may not copy, reverse engineer, modify, distribute, or create derivative works from the Service except where law expressly permits it.
Feedback may be used without restriction or obligation to you, provided we do not identify you publicly without permission.
WordPressDeploy is not affiliated with, endorsed by, or sponsored by the WordPress Foundation, Automattic Inc., or WooCommerce. Third-party marks belong to their respective owners.
8. Fees and subscriptions
If you purchase a paid plan, you agree to the pricing and billing terms presented at purchase. Unless stated otherwise, fees are billed in advance, taxes are your responsibility, and subscriptions renew automatically until cancelled. You may cancel before renewal to avoid the next charge. Except where law requires otherwise or the purchase terms state otherwise, fees already paid are non-refundable.
We may change future pricing with reasonable advance notice. Failed or overdue payment may result in restriction or suspension after notice.
9. Service availability and support
We work to provide a reliable Service but do not guarantee uninterrupted or error-free availability. Maintenance, third-party outages, internet conditions, security events, or circumstances beyond our control may affect access. Support is available at support@wordpressdeploy.com.
10. Privacy
Our Privacy Policy explains how we handle personal information. You agree that you have provided any notices and obtained any permissions required for personal information included in Customer Content.
11. Disclaimers
To the fullest extent permitted by law, the Service is provided “as is” and “as available,” without warranties of merchantability, fitness for a particular purpose, title, non-infringement, uninterrupted operation, or error-free results. Deployment, backup, rollback, caching, monitoring, and security tools reduce operational risk but do not eliminate it. See our Legal Disclaimer for additional information.
12. Limitation of liability
To the maximum extent permitted by law, WordPressDeploy and its owners, personnel, agents, and affiliates will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages or for loss of profits, revenue, business, goodwill, use, or data arising from the Service.
Our aggregate liability for claims relating to the Service will not exceed the greater of one hundred U.S. dollars ($100) or the amount you paid WordPressDeploy in the 12 months before the event giving rise to liability. These limitations apply regardless of legal theory but do not limit liability that cannot lawfully be excluded.
13. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless WordPressDeploy and its affiliates from third-party claims and reasonable expenses arising from Customer Content, your use or misuse of the Service, your violation of these Terms or law, or your infringement of another party’s rights.
14. Suspension and termination
You may stop using the Service at any time and may terminate an account through available controls or by contacting us. We may suspend or terminate access for a material breach, nonpayment, risk to the Service or others, prolonged inactivity, legal requirement, or discontinuation of the Service. We will provide reasonable notice when circumstances permit.
Upon termination, your right to use the Service ends. Provisions that by their nature should survive - including ownership, disclaimers, limitations, indemnification, and dispute terms - will survive.
15. Disputes and governing law
Before filing a legal action, you agree to contact us and attempt to resolve the dispute informally. These Terms are governed by California law, without regard to conflict-of-law rules. Subject to applicable consumer rights, disputes will be brought in state or federal courts located in Orange County, California.
16. Changes to these Terms
We may modify these Terms. We will post the revised Terms and update the date above, and we will provide additional notice when required. Continued use after changes take effect constitutes acceptance. If you disagree, you must stop using the Service.
17. General provisions
These Terms, the Privacy Policy, and any purchase-specific terms are the entire agreement concerning the Service. If a provision is unenforceable, the remaining provisions continue in effect. A failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a reorganization, financing, merger, acquisition, or sale. Neither party is liable for delays caused by circumstances beyond reasonable control.
